These Terms and Conditions govern your purchase and use of FluentMCP software (“Software”) provided by 1WD LLC (“we,” “us,” or “our”).
1. Software License
Upon purchase, you receive a non-exclusive, non-transferable license to use the Software. This is a one-time purchase with lifetime access to the Software version you receive, in the quantity matching whichever license you purchase (eg: 1 site, 3 sites, 10 sites)
2. Updates and Maintenance
We may provide updates, improvements, or bug fixes to the Software at our sole discretion. However, we are under no obligation to provide any updates, maintain the Software, or ensure its continued compatibility with third-party platforms or systems. Updates, when provided, are offered as a courtesy and may be discontinued at any time without notice.
3. No Refunds
All sales are final. Due to the nature of digital software products, and the special pricing afforded hereto, we do not offer refunds under any circumstances once the Software has been delivered.
4. Support
We do not provide personal support, troubleshooting, or consultation services. However, we will make reasonable efforts to respond to emails regarding the Software’s functionality and operation. Response times are not guaranteed, and support is provided at our discretion.
5. No Warranties
The Software is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Software will be error-free or uninterrupted.
6. Limitation of Liability
To the maximum extent permitted by law, 1WD LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Software.
7. Acceptance
By purchasing and using the Software, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
8. Transferability
You may transfer your ownership of any FluentMCP license to another party, including your login to the account you have created on FluentMCP.com. However, we will only recognize one (1) owner of any license at any time, so any such transfer would be considered a relinquishment of any further rights afforded by your initial purchase to any third party buyer.
9. Affiliates
We will track any and all affiliate referrals using link cookies with a thirty (30) day expiration. Commissions will be paid based on completion of a successful sale and the passing of a minimum of sixty (60) days following the transaction to ensure all sales are final and any time has passed for buyer credit card or other issues to be fully resolved. Payouts will be made if any affiliate account has a minimum balance of $97 or more. Affiliates will not be paid for any purchases made to their own accounts, credit cards or personal use, only to new third party buyers, unless explicitly agreed to by 1WD LLC via email or other writing.
